The problem with questioning stuff like that is that if you take Fate  give him an M16 and put him on that road that night with the same task, he would be so afraid he would be shooting at anything that moves.

The two situations are not remotely comparable.  Siege was dealing with the likelihood that the driver was armed, that he was carrying an IED that could be remote detonated, that he had buddies in the neighborhood who were armed, and some chance that the driver or truck was rigged for a suicide attack.
