Dems have formally started the impeachment process against Trump. He's being charged with "Incitement to Insurrection".

Speaking of that, I think it's a slippery slope to have "administrative procedures" that sure look like a government-imposed punishment.  It's wrong with sex offender registries, and it's wrong with no-fly lists. 

I think anything that the government can do to you to materially fuck with your life should be treated as punishment, not a procedure, and thus should have due process and prohibition on retroactive application.  Yes, it's nice when applied to bad people, but if some people in some states voted a little differently two months ago, Trump could be the one on the giving end of such administrative procedures.

The proliferation of administrative procedures is a significant concern. They are everywhere and society would have a hard time functioning without them - if these things, or things like them, had to be funnelled through courts, the already overburdened court systems would collapse. Yet they can be used to abuse and punish. The courts treat administrative procedures with considerable deference, meaning that if an administrative process screws with your life, you will have a difficult time reversing it.

There is no easy answer to this.

If an search that would be illegal for the government to do is done by a private actor, the expectation of privacy is still lost and the government can rely on or repeat the same scope of search.  United States v. Jacobsen, 466 U.S. 109 (1984).  The "private search doctrine"

However, in US v. Jones, the Court held that evidence obtained from the warrantless use of a GPS device attached to a car could not be used even though there was no reasonable expectation in privacy in the car's movements, because it involved a physical invasion of property.

So in this case, the question is does the government's use of information obtained from the parler hijack equivalent to a physical invasion of property?  I don't know if there is precedent on this yet.

If police have issued a warrant for you, you're much more likely to get bail (or at least get more lenient terms) if you turn yourself in, rather than wait for police to pick you up.

I figure they thought things would go easier if they turned themselves in.  Also no fun being cuffed in your home and hauled away for the neighbors to see.
