The grand jury returned one count according to the story.  Who knows what they were told or instructed, as we already have one verifiable incident in this DOJ of misconduct respecting grand juries.

As for the statements by Pirro, she first said: "Our evidence further shows that the National Park Service employees observed Hearn actually forcefully and violently pulling up and removing the bottom liner with both hands."

But then when a reporter asked about Hearn's defense that he simply touched an already damaged liner, she responded, "You know, I'm not going to get into the evidence, but what I told you is what our witnesses saw and experienced. There was an effort, a violent effort, to rip up the sealant from the bottom of the pool. And irrespective of whether or not, you know, we think that there is some situation that preceded it, we can state and prove beyond a reasonable doubt that he caused damage, and that damage is over a thousand dollars."

So she's not going to talk about the evidence, except to talk about the evidence.

As to the $1000 damage threshold, apparently, they intend to call an expert witness to prove that up.  :lol:

The $1000 threshhold matters, because in addition to having to prove beyond a reasonable doubt malicious intent to cause harm, which they clearly have no ability to do, to get the felony charge, they also have to prove that the act caused $1000 damages.  Which means establishing that the value of an already torn and ruined fragment of crappy pool liner is worth more than $1000.

Basically, it's another day, another total shit show embarrassment from the DC US Atty office.

Thanks, MM.  I was unaware that they were using a DC grand jury rather than the federal one they used against Sandwich Guy.
