I haven't had any signs of major depressive disorder in well over a decade now. I would think cured would be a pretty apt description.

Okay, "never" is definitely too strong.  There probably are people who have a MH issue, get over it with therapy, and never look back.

Garbon - you do not need to talk about your personal circumstances - but with my above proviso I still think most MH issues are managed, but not cured.  Taking depression - modern drugs like SSRI inhibitors are wonderful for treating depression, but still require you to take them long term.

Once the restriction on MH for MAID is lifted in 2027, all you need is to have a serious and incurable illness, disease or disability, that causes an "advanced state of irreversible decline in capability", which causes suffering that "cannot be alleviated under conditions the person considers acceptable".

So take major depression.  Without treatment a person's depression causes them to suffer major depressive episodes which are  both a form of suffering and a irreversible decline in capability.  That depression can definitely be treated by drugs, but if the person says that those drugs side effects are not acceptable - then they're eligible for MAID.

Maybe one doctor won't sign off on MAID in such circumstances - but you just need to go find the one who will.

And even though that person's family might want to say "but he's fine when they take the drugs" they don't even have to be notified.

For now tho, Quebec has introduced anticipated MAID.

How is Quebec going to get around the Criminal Code prohibition?  I am not saying its not possible, I just don't know the interaction between the statutes enough to know the answer.

I'm sorry to disappoint - but advanced directives are not by themselves a new idea, and not one I'm opposed to.

Back when I was in private practice we'd frequently sign up advance directives - that would have to do with when to refuse medical services under certain circumstances.  A "do not resuscitate" order is an advanced directive - the difference is just about removing health care, rather than actively causing death.

In fact being able to do a MAID Advanced Directive should actually prevent people from seeking MAID.  Without them, people may want MAID to make sure it happens before they lose the ability to communicate their desires.

Yeah - no issue with a living will.

Though as I mentioned earlier there was a concern around them during covid, and in the inquiry it looks like they were definitely being used wrongfully.

There's at least one NHS Trust that it's now been confirmed was wrongfully issuing blanket do not resuscitate orders based on disability and age not individual assessments or expressed wishes (of the individuals or their families). Sadly, I think there is more to come.

Yeah - like I'd like the option of MAID in the right circumstances as well!  I'm not some right-to-life absolutist.  You won't find me singing "every sperm is sacred".

But I want to avoid the nightmare scenario - the doctor comes in "Very sorry Mr. Barrister, you have cancer.  While at your age of 75 you can probably survive another 5-7 years with treatment, it will ultimately prove fatal.  You have an appointment with your MAID physician in 10 minutes to explain your options" while my kids go "Oh man dad that's terrible!  We'll miss you so much!  But you know the money you leave us will help funds the kids education, and surely you don't want to just linger on for 5-7 years..."

The DPCP (our crowns) has received the order not to prosecute those violation. Trudeau government has said it wasn't going to intervene.
