Not a big fan of the DP.  Besides, as an alleged lawyer, you should know the difference between shooting someone and death by beatdown.  I think the lawtalking term might be "intent".  :P

you don't need a gun to have the intent to kille someone.  Also, you may not have the intent of killing someone while shooting them.
