HAMILTON, Ohio — An Ohio man was sentenced to 11 months in prison Tuesday after pleading guilty to a felony charge for having sex with a pool raft in public.

Edwin Tobergta faced 12 months behind bars after pleading guilty to public indecency, a fifth-degree felony. Tobergta has been convicted three times before to the same offense.

Judge Charles Pater said he encourages Tobergta to take advantage of new sex offender program for people who suffer from developmental disabilities once he's released.

"But I'm not going to put you in that program instead of prison," Judge Pater said.

Tobergta will also have to pay court costs, and at discretion of the parole authority, may get three years probation.

Tobergta, of Hamilton, was arrested for stepping out his back door naked at about 1:20 p.m. June 15 and having "sexual relations with a rubber pool float," according to a Hamilton police report.
Theresa Teague's 10-year-old daughter was enjoying her new swimming pool June 15 when she ran back inside her house and said, "Edwin was doing something weird out there," the Hamilton resident told the Journal-News.

Tobergta was engaging in the sex act with an orange inflatable toy that Teague said a neighbor had put out for the trash.

Tobergta has been arrested for similar offenses, according to Hamilton Municipal Court records.
In August 2011, he was arrested at his home after he was seen engaging in sexual conduct with a pink inflatable swimming pool raft, according to police records.

The incident allegedly occurred in an alley behind his home. The witness, who was the owner of the raft, reported to police that the suspect took the raft with him after being shouted at to stop, according to records.

After the 2011 arrest, police said Tobergta admitted to the act and told officers that he has a problem and needs help.

Following a 2008 conviction for felony public indecency, Tobergta was sentenced to five years community control.

In that incident, officers responded to a home to a report of a naked man standing in a neighbor's yard and engaging in sexual activity, according to records.

A Cleveland man, described as a neighbor of Cleveland kidnapper Ariel Castro, faces 293 counts for the alleged murders of two women, and the rape of several others, including two children.


Law enforcement officials re-examined cases of other missing women in Cleveland following the Ariel Castro kidnappings and obtained the videotaped confessions from Elias Acevedo for two murders committed 18 years ago.

Acevedo, 49, was also indicted Thursday with hundreds of other criminal charges, including rape, gross sexual imposition and kidnapping.

Among those counts are charges related to the alleged kidnapping and rape of two girls, who were aged 8 and 11 at the time, according to NewsNet5.

Acevedo is accused of murdering 30-year-old secretary Pamela Pemberton in 1994. Pemberton, a former neighbor of Acevedo's, went missing after telling family she was going to meet a friend for drinks. Her body was found by a group of teenagers in a field shortly after the killing, according to The Cleveland Plain Dealer.

Acevedo, who lived on the same block as Cleveland kidnapper Ariel Castro, was also charged with murdering an 18-year-old pregnant woman, Christina Adkins, less than three months after he allegedly killed Pemberton. Acevedo recently led authorities to a manhole where a body believed to be Adkins's was found, the Plain Dealer reports.

The indictment against Acevedo says that both murders were committed during alleged rapes of the women.

Acevedo, who police say admitted to both killings, was arrested in June after authorities questioned Castro's neighbors and found that Acevedo was a sex offender who had not reported his current address to the police, Reuters reports.

That month, Acevedo was charged with a 1993 rape he allegedly committed in the same area where Pemberton's body was found the next year. DNA evidence linked him to the rape, police said.

Acevedo will appear in Cuyahoga County court on Monday morning.
