And if you've read the rest of the article, you've have seen that a career DOJ official concluded that the 1967 law had been overridden by a 1978 law and that Trump's appointments were legal.

This one is kind of ridiculous for any state that has the death penalty to agree with.

It's a recital not an operative clause.  When you consider the way the DP is applied worldwide, it is hard to contest that there are widespread violations of human rights that occur.

Somehow I am skeptical that particular recital was the reason for the no vote.  I'm reasonably confident the language would have been tweaked if that would have sufficed to get the US to sign.

I think the link said the US voted in favor of the Russian amendment that removed that clause but the majority voted against it.

If the death penalty is legal in parts of the US, the best move is to vote against the resolution.  Or at least not vote for it-- even the Obama Administration abstained when vote(s) came up during that timeframe.  To vote to condemn a punishment that is allowed in most states and for federal crimes is completely nonsensical.

If there were a separate resolution condemning the disproportionate use of the death penalty against LGBT groups then we absolutely should have voted yes.

Ah - I stand corrected then.  Still don't know why they didn't try to amend by adding the word "sometimes" or even "often"
