The only "innovation" here is in publicizing their intent to do so.  Which I guess has the effect of discouraging visitors from certain areas (but certainly has the effect of discouraging tourism to the US).

It's up to a judge at the end of the day.  Standard, as always, is proof beyond a reasonable doubt.  So sexually explicit photos of a girl who may or may not be under 18?  Pass.  Sexually explicit photos of a girl who is obviously under 18?  Charged.

Dude, these were files investigated by CBSA at Beaver Creek, Yukon land crossing.  Not exactly a hotbed of high tech investigative techniques!

They pretty much just opened a laptop and snooped around.
