Title: New York City aims to ban cigarette sales to under 21s

While an increase in cigarette taxes contributed to a 15-point drop among youth smokers from 1999 to 2007, the number of high-school-aged smokers has held steady at about 8.5 percent over the last six years.

Cigarette packs sold in New York City currently carry a state tax of $4.35 and a city tax of $1.50 - making it the most expensive city in the nation to be a smoker.

"Too many adult smokers begin this deadly habit before age 21," City Council Speaker Christine Quinn said. "By delaying our city's children and young adults access to lethal tobacco products, we're decreasing the likelihood they ever start smoking, and thus, creating a healthier city."

The bill marks the latest effort in the city's decade-long fight to discourage smoking, which the city's health commissioner, Thomas Farley, said was the most significant cause of preventable death in the city. In 2003, Bloomberg outlawed smoking in bars and restaurants, and smoking has since been banned in other public places, including parks.

Quinn, who is running to become the city's next mayor, made clear that she would continue Bloomberg's aggressive public health agenda - which has led his detractors to dub him the "nanny mayor."

MOST TOBACCO USE STARTS IN ADOLESCENCE

While most of the city's anti-smoking initiatives have originated with Bloomberg, the mayor did not join Quinn in making the announcement on Monday, instead sending Farley to say that the mayor looks forward to signing the bill into law.

Every U.S. state prohibits retailers from selling tobacco products to minors and in most states the smoking age is set at 18. Four states - Alabama, Alaska, New Jersey and Utah - require that a cigarette purchaser be at least 19 years old.

In New York, Nassau and Suffolk counties on Long Island have already boosted their legal age for buying cigarettes and other tobacco products to 19.

Nearly all tobacco use starts in childhood and adolescence, according to the 2012 report by the U.S. Surgeon General, which declared smoking a "pediatric epidemic" both in the United States and globally.

According to the report, 99 percent of all first use of tobacco occurs by age 26. The report also found that if youth and young adults manage to avoid smoking or other tobacco products, very few will begin smoking after that age.

Evidence suggests that once youth start smoking, many find it hard to quit. Of all adult cigarette smokers in the United States who smoke daily, 88 percent started smoking by age 18, according to the report.

Currently, about one out of four seniors in high school - youth aged 17 or 18 - smoke on a regular basis. Among those who continue smoking, half will die 13 years earlier than non-smoking peers.

It was not immediately clear how the tobacco industry would respond to the proposed legislation, which Quinn said she hoped would become a model for the rest of the country.

"Our companies follow the law whatever it is in any jurisdiction," said Jane Seccombe, spokeswoman for Reynolds American Inc, the parent company of R.J. Reynolds Tobacco Co, American Snuff Co and Santa Fe Natural Tobacco Co. "We believe no minors, however they're classified in those jurisdictions, should be able to access tobacco products."

She declined to comment on any potential sales impact from changes in the minimum age.

You know, I'm trying to get a Freedom Boner about this and be all irritated...but I just can't. It'd be easier if cigarette smoking were a victimless vice, but second hand smoke sux big time.

Seems pretty obvious that the laws are going to gradually tighten up until cigarette smoking is illegal period.

The hypocrisy is, as Malthus pointed out, the drive to eventually make cigarettes illegal.  People like Bloomberg and Quinn want overly strict laws on cigarettes.  They probably do not support relaxing pot laws, either, though.

That's not really hypocritical then. :hmm:

Besides, it isn't like places are saying you can smoke weed anywhere you feel like it, are they?

Also, smoking isn't the only way to consume weed - but probably the only way to consume a cigarette.  :shutup:

Indeed, but it makes no sense to just restrict it for minors. It makes much more sense to treat it like the public health hazard it is and forbid it in public.

Well I think at this point, only the sidewalks are left in New York. Banned indoors where people work and in parks.

I suspect eventually they will both end up in the same place, eventually - illegal to use in public; the cops will enforce what amounts to a fine if you are annoying someone with it.

Eventually, the state will find a way to tax and regulate sale of both, to the very edge of where taxing/regulating makes smuggling profitable and widespread.

Widespread public disapproval (and legal strictness) makes, and will increasingly make, smoking an unviable addiction. You can enjoy the occasional joint in your off-hours easily enough, but it's really hard to be a smoker like that - most need to smoke periodically all day, and this will become increasingly difficult to do and live a normal lifestyle.

Oh yeah, you're the modern equivalent of a leper these days.  It's already banned in so many public places here as it is.  The Maryland Senate passed a bill this session banning smoking in your car with child passengers under the age of 8.

Well I can't speak for Canada but we certainly have seen increasingly tight regulations on smoking.

And planes!

Actually, it was pretty funny when I was at Denver airport in March and there was a restaurant with a smoking section. So many people got up and left in disgust because some of the smoke fumes drifted into the general restaurant (unlike in the past though, this smoking section was actually an enclosed room with separate entrance).

Most restaurants around me don't have smoking sections at all.... meaning you can smoke wherever you like. :)

I don't mind the secondhand smoke that much since my parents were chain smokers when I was a kid (both have finally quit smoking altogether... it took my dad suffering a collapsed lung to finally stop).

The taxes were a pure money grab - sin taxes are easy for politicians to approve. Though as was discovered, take it too far and with sovereign Indians conveniently living on the border ...  ;)

The increasing restrictions is something else again - a more or less concerted effort to get rid of a habit widely seen as antisocial, in the face of some strong political resistance. A similar attempt re: guns is failing to take hold, south of the border.

Gradually, the anti-smoking types are winning, as popular consensus swings against smoking. The fewer smoke, the easier it will get to pass anti-smoking legislation, and the weaker the political resistance will be - and the less will the majority tolerate smoking.

I mainly mind it in mornings...and I guess when I think about how it is increasing my chances of cancer.  Despite restrictions here, I actually think I know more smokers in NYC then I knew in SF...which is also odd as I don't think I've had a cigarette here in New York.

My mother remembers being able to smoke at the nurse's stations in hospitals.

As someone who has a lung disease likely caused by inhaling second hand smoke I am all for public restrictions on smoking and a ban on smoking around children.

I am also for a ban on smoking in public because whenever I go near someone smoking on the street it makes my lungs go nuts.  But I can understand why this woudn't be a major factor for everyone.

Sidewalks are still pretty public. You could argue they're the most public places of all.

It is quite common, and very reasonable, to restrict actions harmful to public health in public places.

Sidewalks are still pretty public. You could argue they're the most public places of all.

It is quite common, and very reasonable, to restrict actions harmful to public health in public places.

I mean, damn son, parks were only fairly recent. Change takes time if you don't want a backlash. ;)

Also the park thing changes a lot in New York as there are actually a lot of parks that one walks through as short cuts. At my old job, I had to walk around the park with a co-worker so she wouldn't get fined. :D

NYC is a couple hours' drive from like seven different states. That's got to blunt the effect of things like this. Not like if it were Denver.

I'm not sure how many teens in New York are going to be driving around to buy cigs.

Also, I don't know how you drive but from my experience, 2 hours can only get you to PA, NJ or CT. :P

Ah I forgot about that piece of Delaware snaking up. Alright point conceded.  Though I think it is about as fair a comment as saying you won't get much more in tax if you increase taxes on cigs in the city because people can travel to buy them elsewhere. While I've been with smokers who bought cheaper cigs down in southern Jersey, those purchases don't account for most of their cigarette purchases.

In late 2012, he tried to ban super-sized sugary soft drinks on health grounds sparking angry complaints.

A judge blocked the measure in March, calling it arbitrary, although a final appeal is still pending.

Although New York City was exempt, a US judge this month ordered an end to a smoking ban imposed in public parks and beaches across New York state.

New York City in 2002 pioneered a ban on smoking in bars and restaurants that was initially criticized, but since has been adopted in cities across Europe and the West.

Since 2011, it has also been illegal to smoke on public beaches, parks and public swimming pools in New York City, and its cigarette taxes are the highest in the US.

Bloomberg, who steps down on January 1 after 12 years in office, highlighted health as part of his legacy in an interview with Forbes' November 18 issue magazine.

"You want to leave the world a better place for your kids. From a selfish point of view, you want people to think you've done a great job," he was quoted as saying.

"In this city 8.5 million people are living on average 2.5 years longer than they did 12 years ago. Imagine if it went the other direction!"

New York goes to the polls on Tuesday to elect Bloomberg's successor, with Democratic candidate Bill de Blasio enjoying an historic lead in opinion polls.

Thirty years ago, you could smoke pretty well everywhere, and people did. There were ashtrays in offce building elevators. There were smoking sections in restaurants.

I am so glad those days are gone! I  can't imagine the stench from being in closed places all the time with the smoke. I think it wasn't so much noticed years ago when that kind of thing was going on but now I notice it if I'm somewhere that people are smoking, even just at a friend or relative's house where just one person is smoking. It seems like I have to fumigate my clothes afterwards as the stench is horrible.

That said, I don't like the demonization of smokers. Bad habit but if they want to smoke it's their choice. The second hand smoke I might encounter now is just a whiff of it in an open space and I don't worry about that. But I avoid places like restuarants and such where I can smell the smoke from a smoking section.

Yeah, that's what I figured. The smell was so common that we/I hardly took notice of it.
