AFAIK, "justifiable homicide" only covers "authorized use of deadly force" and "reasonable self defense." The former doesn't cover personnel that are off-duty or not active, and the latter isn't universally recognized.

Is true.  Generally, you get the Cross by barely being ineligible for The Medal.  The defense would just have to read the citation, and the jury wouldn't leave the box before rendering the not-guilty verdict.
