Let's phrase this question differently. You have two suspects. You know one of them is guilty but the other one is innocent. But you have no way of establishing which is which. I think our Western philosophy of criminal justice directs you to free them both, rather than lock them both up, right?

I think your question is similar (albeit for different reasons). Do we punish an innocent man so that we can get the criminal too, or do we let the criminal walk free so that we do not punish an innocent man.
