there's way too little information there to know what's going on. the lawyers are activists, and there's no confirmation any detainees are actually there. plus, no idea on what's going through the internal chain of command. until there's a federal (edit - court) ruling, it's far too hasty to say there's a constitutional crisis going down

DHS is complying with the orders. the orders were for the detainees currently in the US, nothing more. DHS is complying, and they're carrying out the rest of the executive order, which the orders didn't touch

this is part of the hysteria. as if the federal government is going to intentionally ignore federal court orders

CBP is not complying with court orders, as a cursory examination of the news would demonstrate.  Posts like your are part of the hysteria whipped up by trump supporters who freely lie about the facts, and then accuse the news of lying in hopes that the public is as stupid as the Trump supporters.

In fact, it is statements like "as if the federal government is going to intentionally ignore federal court orders" that show the dishonesty of the Trumpeters.  "The federal government" includes the judges issuing orders; of course they are not ignoring their own court orders!  But the CBP, by denying detainees access to lawyers in contravention of the court order, is ignoring that order.  Note how I specify the people ignoring the order, and the Trumpeter just uses vague generalities like "the federal government" in his denials.

It takes many years to acquire a foreign passport.  It maybe time for Americans to think about getting some form of insurance

this is a pretty decent article that explains more. seems like the dulles branch is being sluggish with complying, but that's to be expected given this whole mess. CBP is complying with the orders in other areas. so, whatever is going on is some internal thing, not a flat refusal by CBP to resist federal courts across the nation. if it continues to resist, that's different. but right now, like I said, it's way too early to say a constitutional crisis is going on.

grumbler, CBP was releasing people earlier. it's probably a branch-by-branch thing going on and there's not much organization given how rushed this all was

On what basis are they denying access to counsel?

some dude probably doesn't want to risk losing his job, so he's waiting until further orders

Who do you think the head of CBP needs to hear from to get orders to obey the Constitution he's sworn to uphold?

Yeah, "waiting on orders" is no basis to deny access to counsel.

At least in non-shit countries.

might as well rephrase this as "who you think low-ranking agent #105 needs to hear from to get orders to obey the constitution he's sworn to uphold." people adhere to chain of command

I'm not saying that's a legal basis to deny access to counsel. I'm saying it's too soon to say a constitutional crisis is going down.

This weekend was the first time since Nuremberg that anyone has trotted out the old "They vere chust following ordersss!" defense with any hope it would be swallowed.
