There's alwys cause for concern when you allow Ken Cuccinelli to touch anything.  He was Virginia's Attorney General and engaged in any number of boneheaded legal cases at taxpayer expense, which he then lost.  I wouldn't trust him to scoop up dog shit without fucking it up.

I have obviously no idea about the US, but over here such a contract would be effectively unconstitutional (government and parliament can't bargain away their prerrogatives outside of laws).

Not exactly because the Local can appeal the withdrawal.  No clue what the standard of review is on that.

In normal contract and agency law, an agent with apparent authority can bind a principal even if he lacks actual authority, if the counterparty relies on the apparent authority
