Go for the Presidency.  The First Amendment is a confused mess.  On the other hand, I have never heard of a course on the Presidency that involved screening porn in class, and I have heard about porn in First Amendment classes, so you may want to inquire first.

I took a 400 level class on the American Presidency and it rocked, so I vote for that.

Faye: Ordinary. The kind of beautiful, dangerous ordinary that you just can't leave alone.
Jet: I see.
Faye: Like an angel from the underworld. Or a devil from Paradise.

Does your school do student class reviews?

Or you could shop both during add/drop.

Or if you're inclining pre-law take the 1st Amendment; if you're inclining history take presidents.

Ask around.  Look at their research interests on the Uni website and see if it's the sort of thing you're interested in because it'll probably have some bearing.

I personally would go with which requires the least effort to get a B.

He can fix that by taking law or medicine in post-grad.
