The reality is that the filibuster is dead. Whether it died now or later, the GOP were going to kill it. Might as well get it out of the way now and make it clear how the GOP rolls, keeping it closer to their intransigence re: Garland.

The Dems got rid of the filibuster in 2013 over lesser judicial appointments - they kept it in for USSC positions.

Even now the Republicans are keeping the filibuster for legislation.

AFAIK, the Senate can change its rules whenever it likes.  If they want to bring back the filibuster, they can.  And then if they want to remove it again for certain circumstances, they can.

I don't think they picked it. Trump is to toxic to compromise with. They don't have the guts or leadership to take a stand without being forced by external factors.

What was more pathetic than the filibuster attempt IMO is that the Dems could not really enunciate any solid reason to not confirm Gorsuch.
